  • Danny’s Biography

    Danny Gurwitz, a firm partner, has been a litigator with Atlas, Hall & Rodriguez, LLP for almost 30 years.

    Danny has litigated business and partnership break-ups; will contests and trust busting cases; products liability claims; toxic torts; food borne contamination; insurance coverage disputes, patent infringement, and employer/employee disputes (including wrongful termination and enforcement of restrictive covenants). He represents healthcare professionals in fraud investigations (including those involving Medicaid and Medicare); claims for overpayment, recoupment and related matters; investigations by hospital credentialing committees, as well as representing health care professionals before the Texas Medical Board.

    Danny regularly represents general contractors and large subcontractors in negotiating construction contracts, and litigating collection, lien enforcement, and construction defect and delay claims on their behalf. He also has an active practice representing banks in work-outs with debtors and in defending them against lender liability suits. Some notable outcomes in cases for which Danny was lead counsel include:

    • Obtaining judgment after trial against employee who violated non-compete agreement;
    • Obtaining million dollar + settlements for clients in multiple will contests;
    • Obtaining $10 million dollar verdict after trial in a commercial breach of contract and breach of fiduciary duty case;
    • Successfully settling on behalf of target defendant nationwide suits involving
      over a dozen alleged deaths and over 100 injuries arising from contaminated produce;
    • Obtaining jury verdict of approximately $7 million in eminent domain case;
    • Settling eminent domain case for $8.5 million, 4x condemnor’s original offer;
    • Negotiating separation agreement for CEO of largest charter school district in the U.S.;
    • Obtaining dismissal of alleged multi-million dollar False Claims Act case against physician and related health care facilities;
    • Obtaining summary judgment on behalf of bank in multi-million dollar lender liability suit;
    • Obtaining judgment after trial on behalf of bank in lender liability suit;
    • Successfully settling multiple construction defect cases, each with multi-million dollar damage models, on behalf of target general contractor defendants

    Danny is AV rated by Martindale Hubbell, has been recognized and named as a Texas Rising Star and subsequently named as a Texas Super Lawyer as awarded by Thompson Reuters and published in Super Lawyers/Texas Monthly magazine. He also has been elected into membership in the American Board of Trial Advocates (ABOTA).
